Estos términos regulan el uso de la app GiftU y del sitio giftu.app (juntos, "GiftU"), operados por Jorge Andrew García, con domicilio en Paseos del Bosque II, Calle Encino Rojo, Mz. 25, Lt. 1, Ojo de Agua, Tecámac, Estado de México, México. Al crear una cuenta o usar GiftU aceptas estos términos y nuestra política de privacidad. Si no estás de acuerdo, no uses GiftU.

These terms govern the use of the GiftU app and the giftu.app website (together, "GiftU"), run by Jorge Andrew García, based in Paseos del Bosque II, Calle Encino Rojo, Mz. 25, Lt. 1, Ojo de Agua, Tecámac, Estado de México, México. By creating an account or using GiftU you accept these terms and our privacy policy. If you don't agree, don't use GiftU.

GiftU es una herramienta gratuita para organizar intercambios de regalos y amigo secreto: crear el intercambio, invitar participantes, hacer el sorteo y compartir listas de deseos y gustos. GiftU no vende productos, no procesa pagos y no entrega regalos.

GiftU is a free tool to organize gift exchanges and Secret Santa: create the exchange, invite participants, draw names and share wishlists and tastes. GiftU doesn't sell products, process payments or deliver gifts.

• Debes tener al menos 13 años. Si eres menor de 18, necesitas el permiso de tu madre, padre o tutor.
• Da información verdadera y mantén tu correo actualizado: lo usamos para invitaciones y avisos.
• Cuida tu contraseña. Eres responsable de lo que se haga desde tu cuenta; avísanos si crees que alguien más entró.
• Cada cuenta es personal: no la compartas ni la vendas.

• You must be at least 13 years old. If you're under 18, you need your parent's or guardian's permission.
• Give true information and keep your email up to date: we use it for invitations and notices.
• Keep your password safe. You're responsible for what happens in your account; tell us if you think someone else got in.
• Each account is personal: don't share or sell it.

Al usar GiftU te comprometes a no:

• Invitar a personas que no te dieron permiso, ni usar las invitaciones para mandar spam.
• Publicar contenido ilegal, ofensivo, violento, sexual o que viole derechos de otras personas.
• Hacerte pasar por otra persona o engañar a los participantes.
• Intentar ver información que no te corresponde, como el resultado del sorteo de otros.
• Interferir con el servicio, automatizar su uso o extraer datos de forma masiva.

When using GiftU you agree not to:

• Invite people who didn't give you permission, or use invitations to send spam.
• Post content that is illegal, offensive, violent, sexual or that violates other people's rights.
• Impersonate someone else or deceive participants.
• Try to see information that isn't yours, such as other people's draw results.
• Interfere with the service, automate its use or scrape data in bulk.

Lo que agregas (fotos, textos, listas y links) sigue siendo tuyo. Nos das permiso de guardarlo y mostrarlo a las personas de tus intercambios, solo para que GiftU funcione. Ese permiso termina cuando lo borras o eliminas tu cuenta.

Solo sube fotos y textos sobre los que tengas derechos. Podemos quitar contenido que viole estos términos.

What you add (photos, text, lists and links) stays yours. You give us permission to store it and show it to the people in your exchanges, only so GiftU can work. That permission ends when you delete it or your account.

Only upload photos and text you have rights to. We may remove content that violates these terms.

• El organizador define el nombre, la fecha, el lugar y el rango de precio, y decide cuándo hacer el sorteo. Los acuerdos del grupo (qué, cuándo y dónde se regala) son entre los participantes.
• El sorteo es aleatorio y nadie se saca a sí mismo. Si alguien sale después del sorteo, se vuelve a sortear entre los demás.
• Apartar un regalo es solo un aviso para el grupo: no es una compra ni una reserva en la tienda, y no garantiza que el producto siga disponible.
• GiftU no es responsable de regalos que no se compren, no lleguen o no gusten.

• The organizer sets the name, date, place and price range, and decides when to draw names. What the group agrees on (what, when and where gifts are given) is between the participants.
• The draw is random and nobody draws themselves. If someone leaves after the draw, names are drawn again among the rest.
• Setting a gift aside is only a note for the group: it isn't a purchase or a store reservation, and it doesn't guarantee the product will still be available.
• GiftU isn't responsible for gifts that aren't bought, don't arrive or aren't liked.

GiftU no está afiliada a Mercado Libre, Amazon ni a otras tiendas, y sus marcas pertenecen a sus dueños. Cuando agregas un link, tomamos el nombre, el precio y la foto de la página pública del producto; esos datos pueden cambiar o no ser exactos, así que revisa siempre la información en la tienda antes de comprar.

Las compras se hacen directo con cada tienda y se rigen por sus términos, precios, envíos y devoluciones.

GiftU isn't affiliated with Mercado Libre, Amazon or other stores, and their trademarks belong to their owners. When you add a link, we take the name, price and photo from the product's public page; that information may change or be inaccurate, so always check it in the store before buying.

Purchases are made directly with each store and are governed by its terms, prices, shipping and returns.

La marca GiftU, el logotipo, el diseño, las ilustraciones y el software son de Jorge Andrew García. Te damos una licencia personal, gratuita, no exclusiva e intransferible para usar la app conforme a estos términos. No puedes copiarla, modificarla ni distribuirla.

The GiftU brand, logo, design, illustrations and software belong to Jorge Andrew García. We give you a personal, free, non-exclusive and non-transferable license to use the app under these terms. You may not copy, modify or distribute it.

Trabajamos para que GiftU esté siempre disponible, pero puede haber interrupciones por mantenimiento o fallas. Podemos agregar, cambiar o retirar funciones; si retiramos algo importante te avisaremos con anticipación razonable.

We work to keep GiftU always available, but there may be interruptions for maintenance or failures. We may add, change or remove features; if we remove something important we'll give you reasonable notice.

Puedes dejar de usar GiftU y eliminar tu cuenta cuando quieras. Podemos suspender o cerrar cuentas que violen estos términos o pongan en riesgo a otras personas o al servicio; cuando sea posible, te avisaremos y te explicaremos el motivo.

You can stop using GiftU and delete your account whenever you want. We may suspend or close accounts that violate these terms or put other people or the service at risk; when possible, we'll let you know and explain why.

GiftU se ofrece gratis y "tal como está". En la medida en que la ley lo permita, no somos responsables de daños indirectos ni de pérdidas derivadas de acuerdos entre participantes, compras en tiendas de terceros o información de productos tomada de sus páginas.

Nada en estos términos limita los derechos que te da la Ley Federal de Protección al Consumidor.

GiftU is offered free of charge and "as is". To the extent the law allows, we aren't liable for indirect damages or for losses arising from agreements between participants, purchases in third-party stores or product information taken from their pages.

Nothing in these terms limits your rights under Mexico's Federal Consumer Protection Law.

Si descargas GiftU desde App Store o Google Play, también aplican los términos de esas tiendas. Apple y Google no son parte de estos términos ni responsables de GiftU o de su soporte. Si descargaste la app desde App Store, Apple y sus subsidiarias son terceros beneficiarios de estos términos y pueden hacerlos valer.

If you download GiftU from the App Store or Google Play, those stores' terms also apply. Apple and Google aren't parties to these terms and aren't responsible for GiftU or its support. If you downloaded the app from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

Estos términos se rigen por las leyes de los Estados Unidos Mexicanos. Cualquier controversia se resolverá ante los tribunales competentes del Estado de México, sin perjuicio de tu derecho a acudir a la Procuraduría Federal del Consumidor (PROFECO).

These terms are governed by the laws of Mexico. Any dispute will be settled before the competent courts of Estado de México, without prejudice to your right to go to the Federal Consumer Protection Agency (PROFECO).

Podemos actualizar estos términos. Publicaremos la nueva versión aquí con su fecha y, si el cambio es importante, te avisaremos en la app o por correo. Si sigues usando GiftU después de un cambio, aceptas la nueva versión.

We may update these terms. We'll post the new version here with its date and, if the change is significant, let you know in the app or by email. If you keep using GiftU after a change, you accept the new version.
